1. General Conditions

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including if we suspect fraudulent activity or violation of these terms.

2. Products and Pricing

All prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product at any time. We make every effort to display the colors, finishes, and descriptions of our pedals accurately, but we cannot guarantee that your device's display will reflect the exact color of the physical product.

We reserve the right to limit the sales or quantities of our products to any person, geographic region, or jurisdiction. We may limit or prohibit orders that appear to be placed by unauthorized dealers, resellers, or distributors.

3. Accuracy of Billing and Account Information

You agree to provide current, complete, and accurate purchase and account information for all orders made at our store. You agree to promptly update your account and other information, including your email address, so that we can complete your transactions and contact you as needed. In the event we cancel or change an order, we will attempt to notify you via the email address provided.

4. Shipping, Customs, and International Orders

If you are placing an order to be shipped outside of the European Union, please be aware of the following:

  • Import Duties and Taxes: Your order may be subject to import duties, taxes (including VAT), and customs clearance fees once the shipment reaches your destination country. These charges are not included in our prices or shipping costs.
  • Responsibility: You, as the importer, are solely responsible for paying all import duties, taxes, and fees. We have no control over these charges and cannot predict what they may be.
  • Customs Delays: Shipments outside the EU may experience delays due to customs processing. These delays are outside our control.
  • Refused Shipments: If you refuse a shipment due to unexpected import charges, the original shipping cost is non-refundable, and you may be responsible for return shipping costs and any additional fees incurred.

5. Returns and Refunds

Your purchases are governed by our Refund Policy, which outlines your 14-day right of withdrawal and instructions for returning items.

6. Warranty and Consumer Rights

We stand behind our work. All Drunk Beaver pedals come with a lifetime warranty against manufacturing defects and internal component failures. Whether it is a faulty footswitch or an issue with the przesteru circuitry, if your pedal develops a fault under normal use, contact us and we will repair it. Please note that this lifetime warranty does not cover cosmetic wear and tear, damages caused by misuse, the use of improper power supplies, or unauthorized modifications.

For third-party items and merchandise (such as apparel or accessories), consumers in the European Union are protected by statutory warranty rights (rękojmia w Polsce), which guarantee that these products will be free from defects in material and workmanship for a period of 2 years from the date of delivery.

If any item arrives defective or develops a fault covered by these warranties, please contact us at info@drunk-beaver.rocks so we can evaluate the issue and arrange a repair, replacement, or refund in accordance with our policies and EU law.

7. Website Use and Intellectual Property

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service, the website, or our product designs without our express written permission. You are prohibited from using the site or its content for any unlawful purpose, to infringe upon our intellectual property rights, or to upload malicious code or viruses.

Our store may contain links to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of these third-party sites and hold no liability for any harm or damages related to the use of third-party websites or services.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Poland. For consumers residing in the EU, you also enjoy the protection of the mandatory provisions of the law of your country of residence.
